Welcome to the website (the "Site") of Apostrophe Puzzles, LLC (“Company”, “we”, “us” and/or “our”). The Site is operated by Company and has been created to provide information about our products (the “Company Services”) to our Site visitors (“you”, “your”). This Privacy Policy explains the types of personal data we collect and process, how we may use and share that data, and the choices that are available to you with respect to our handling of your personal data.

Personal Information We Collect

When you interact with us through the Site, we may collect Personal Data and other information from you, as further described below:

Personal Data that you provide through the site:

We collect Personal Data from you when you voluntarily provide said information, such as when  you make a purchase or attempt to make a purchase through the Site, sign up for waitlists, ask to receive emails, contact customer service, interact with us on social media, or use certain Company Services. The types of Personal Data we may collect directly from you include: Contact information, such as your name, email address, mailing address, and phone number; Billing information, such as credit card details and billing address; Optional information you may choose to provide, such as your social handles, art preferences, age range, gender; and any other information you choose to provide, such as product reviews, responses to surveys or quizzes, or to receive customer support. We refer to this information as “Order Information”. We also may collect Personal Data that you provide to us by granting us administrative access to your social media accounts, including Facebook, and via Google Analytics. 

*By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to the Site, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Company and the authorized third parties referred to herein located in the United States. Wherever Company collects Personal Data we make an effort to provide a link to this Privacy Policy.*

Information we collect by automated means

When you visit our Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. 

When we talk about “Personal Information/Data” in this Privacy Policy, we are talking both about Device Information and Order Information.

In operating the Site, we may use cookies, log files, web beacons, and/or similar technologies. A “web beacon,” also known as a pixel tag or clear GIF, is an electronic file used to record and transmit information back to a web server. Information we collect from other sources

We may also collect information about your online activities over time and across third-party websites, including third-party social media services. When you access our site or engage our services through a social network, we collect information about you from the social network in accordance with your settings on the social network. If you interact with us on social media, we will collect information about those interactions. The information we may collect includes your name and email address.


Other information:

Non-Identifiable Data: When you interact with Company through the Site, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. Company may store such information itself or such information may be included in databases owned and maintained by Company affiliates, agents or service providers. The Site may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.

Our use of your personal data and other information:

We use the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided, as further described below:

We use the Order Information that we collect generally to deliver the products and Services you request, to provide, maintain, and improve our Services, and to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). 

Additionally, we use this Order Information to:

- Communicate with you;

- Monitor, audit and analyze trends, usage, and activities in connection with our Services;

- Screen our orders for potential risk or fraud;

- Detect, investigate, and respond to security incidents and protect against illegal or   

  objectionable activities, including the unauthorized use of the Services, and to protect the rights and property of Apostrophe Puzzles and others;

- Comply with our legal obligations, including those required for you to benefit from rights recognized by law, or any regulatory requirements or provisions; and

- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.


We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Who may have access to your information

We are not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:

Within Apostrophe Puzzles: We may disclose certain of your personal information to Apostrophe Puzzles affiliates and personnel who need to know the information for the purposes described above, including personnel in the customer service and information technology departments.

Business Transfers: As we continue to develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

Agents, Consultants and Related Third Party Service Providers: Company, like many businesses, sometimes hires other companies to perform certain business-related functions. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function. We may use third party service providers acting on our behalf to perform some of the services described above. For example, we share certain information with service providers who assist with the processing of credit cards and payments, hosting, managing and servicing our data, distributing emails, conducting research and analytics, advertising, or administering certain services and features. We also may share information about you with our professional advisors, including accountants, auditors, lawyers, insurers and bankers, if needed. These service providers may change over time, but we will always use trusted service providers who we require to take appropriate security measures to protect your personal information in line with our policies. We only permit them to process your personal information for specified purposes and, as appropriate, in accordance with our instructions and the provisions of this Policy and applicable law.

Legal Requirements: Company may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Company, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.

Advertising and Analytics Services Provided by Others: As described above, we may allow others to provide analytics services and serve advertisements or targeted marketing communications on our behalf across the internet and in mobile applications. This information may be used by Apostrophe Puzzles and others to, among other things, analyze and track data, determine the popularity of content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity. Your rights and choices

You can use the Site without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain Company Services.


No Sale of Personal Data:

Apostrophe Puzzles does not and will not sell personal data as the term “sell” is defined by the CCPA.

Exclusions:

This Privacy Policy does not apply to any Personal Data collected by Company other than Personal Data collected through the Site. This Privacy Policy shall not apply to any unsolicited information you provide to Company through the Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as comments related to the Products (collectively, "Public Areas"), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be publicly posted and therefore non-confidential, and Company shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

This Privacy Policy applies only to the Site. The Site may contain links to other web sites not operated or controlled by Company (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Site do not imply that Company endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies. For instance, we use a third party payment processor to accept and process credit and debit card payments when you purchase our products and services. The information provided to the payment processor is governed by the payment processor’s privacy policy. As of August 2020, the Company uses Stripe as our third party payment processor. Stripe’s Privacy Policy is located at https://stripe.com/us/privacy. We may change the payment processor in the future.

Social media:

Through the Site, you can choose to access certain social media websites and services that are owned and/or controlled by third parties (including, without limitation, Facebook, Twitter, and Instagram) such websites and services, collectively, the "Social Media Services"). When you elect to access and use the Social Media Services, you will be sharing your information (which will include personal information if you elect to share such information) with those Social Media Services. As with other Third Party Sites, the information that you share with the Social Media Services will be governed by the privacy policies and terms of service of the providers of such Social Media Services and not by the policies and procedures we describe here. You may also be able to modify your privacy settings with these Social Media Services to, for example, control what information the Social Media Services disclose to other entities, including Company. When you log into the Site using your Social Media Services account, we will collect relevant information necessary to enable the Site to access that Social Media Service, however you will provide your login information, like your password, directly to such Social Media Service (and not to Company). As part of such integration, the Social Media Service will provide Company with access to certain information that you have provided to such Social Media Service, and we will use, store and disclose such information in accordance with this Privacy Policy and, if and to the extent applicable, the policies of such Social Media Services. However, please remember that the manner in which Social Media Services use, store and disclose your information is governed by the policies of the applicable Social Media Services provider, and, as a result, Company shall not have any liability or responsibility for the privacy practices or other actions of Social Media Services that may be enabled within and/or otherwise accessible through the Site.

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Opting out of email marketing:

You may unsubscribe from our promotional emails at any time by following the instructions included in those emails. If you opt out of receiving such communications, note that we may continue to send you non-promotional emails (such as order confirmation emails or emails about changes to our legal terms).

Restricting cookies:

Most web browsers are set to accept cookies by default. As stated above, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our websites.

Web Push Notifications/Alerts:

With your consent, we may send promotional and non-promotional push notifications or alerts to your browser. You can deactivate these messages at any time by changing the notification settings on your browser.

Children:

Our Services are not designed for children and we do not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not submit any Personal Data through the Site. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children never to provide Personal Data on the Site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to Company through the Site, please contact us, and we will endeavor to delete that information from our databases.

Data Transfers: 

Apostrophe Puzzles is headquartered in the United States, and we have operations and entities in the United States and other countries. As such, we may transfer your personal data to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. We will take steps to ensure that your personal data receives an adequate level of protection in the jurisdictions in which we process it.

Security:

Company takes reasonable steps to protect the Personal Data provided via the Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from the Site may not be secure. Therefore, you should take special care in deciding what information you send to us via e-mail. Please keep this in mind when disclosing any Personal Data to Company via the Internet.

Changes to company’s privacy policy:

We may change this Privacy Policy from time to time. If we do so, we will post the updated policy on our sites and will indicate when the Privacy Policy was last revised. If we make any material changes, we will provide you with additional notice. Your continued use of the Site after any such changes constitutes your acceptance of the new Privacy Policy. You should periodically visit this page to review the current Privacy Policy so you are aware of any revision to which you are bound.
